NIA Special Court convicts 21 in Kannur PFI Terrorist Training Camp case in Kerala.

On 20.01.2016, Hon’ble Special Court for Trial of NIA cases, Ernakulam, Kerala found 21 accused persons guilty of the charges including criminal conspiracy, membership of unlawful assembly, possession of arms and explosive substances, inciting communal disharmony, assertions prejudicial to national integration besides organizing terrorist camp in NIA case RC 05/2013/NIA/KOC (Kannur PFI Training Camp case).

2. The case pertains to conduct of a secret training camp in use of swords and explosives inside a building owned by Thanal Foundation Trust at Narath in Mayyil Police Station limits of Kannur district, Kerala on 23.04.2013 by activists of PFI/SDPI. 21 persons were arrested and initial investigation was conducted by Kerala Police. The case was subsequently transferred to the NIA in August, 2013 and charge sheet was filed against 22 accused persons in October, 2013.

3. Accused Abdul Azeez (A-1) was found guilty and convicted for the offences under sections 120 B (6 months), 143 (6 months), 153-A (1 year) & 153 (B) (1) (c) (1 year) of IPC, section 25 (1)(a) read with section 27 of Arms Act (3 years and fine Rs.1000/-), Sections 4 (5 years and fine Rs.1000/-) & 5 (5 years and fine Rs.1000/-) of Explosive Substances Act besides sections 18 (5 years and fine Rs.1000/-) and 18 (A) (5 years and fine Rs.1000/-) of Unlawful Activities (Prevention) Act, 1967.

4. Accused Abdul Azeez (A1) has been sentenced to undergo imprisonment for the offences under sections 153-A (1 year) & 153 (B) (1) (c) – (1 year) of IPC consecutively and for the other offences concurrently. In result, he has to undergo simple imprisonment for 7 years and pay fine of Rs. 5000/-.

5. Accused Fahad (A2), Jamsheer (A3), Abdul Samad (A4), Mohammed Samreed (A5) Noufal (A6), Rikkas (A7), Jamsheed (A8), Mohammed Ashiq (A9), Missaj (A10), Mohammed Absheer (A11), Ajmal. P.M (A12), Hashim NIA Hqrs. Date: 21/01/2016 (A13), Faisal (A14), Rabah (A15), Shijin @ Siraj (A16), Noushad (A17), Suhair (A18), Ajmal C.M (A19), Shafeeq (A20) & Rashid (A21) were found guilty and convicted for the offences under sections 120 B (6 months) , 143 (6 months) of IPC, Section 25 (1)(a) read with section 27 of Arms Act (3 years and fine Rs.1000/-), Sections 4 (5 years and fine Rs.1000/-)& 5 (5 years and fine Rs.1000/-) of Explosive Substances Act besides sections 18 (5 years and fine Rs.1000/-)and 18 (A) (5 years and fine Rs.1000/-)of UA(P) Act, 1967.

6. Accused A2 to A21 have been sentenced to undergo imprisonment concurrently. In result, they have to undergo simple imprisonment for 5 years and pay fine of Rs. 5000/-.

7. Accused Khamarudheen (A22), has been acquitted of all the charges against him.
