Supreme Court dismisses application seeking stay on Pune Metro

4 July 2019, Pune : Activist Sarang Yadwadkar filed miscellaneous application for direction in the order dated 15.02.2019 passed by Supreme court in Civil Appeal no. 1054 of 2019. The applicant filled OA No 67 of 2016 before National Green Tribunal (NGT) seeking stay on the project in the pretext of construction of Pune Metro rail project being constructed in the Mula-Mutha riverbed being threat to the environment.

The NGT vide order dated 03/08/2018 titled as Sarang Yadwadkar & Others Vs. Pune Municipal Corporation & others, disposed off the application in view of expert committee report dated 04/01/2018.

The applicant filed appeal of NGT order dated 03/08/2018 before the Supreme Court. The Supreme Court vide order dated 15/02/2019 observed that there is no reason to interfere with the order of NGT. However, committee was directed to give a hearing to the applicants on a fixed data and consider their objections. The Committee shall there upon accommodate the applicant’s objections and suggest any suitable modifications, if required, which shall be carried out by the respondent authorities. If the committee does not upload the objections it may give reasons.

In compliance to the aforesaid orders, the committee extended hearing to the applicant on 13/03/2019 and his objections were heard. Now the applicant has filled again an application seeking stay on the project. The Supreme court after hearing the case dismissed it as withdrawn.
