Pune: Case Of Fraud Against Builder For Starting Construction Of Floor Without Consent Of Society Members
Nana Peth, 20th December 2022: A case has been registered at Samarth police station under Pune city police against Shah Sanghvi Associates and partners of the firm for not handing over the society after starting the construction of the fourth floor located at City Survey No 563 C and 563 D in Nana Peth. The said incident took place between 2011 and 2022, at Mayfair Arcade Society in Nana Peth.
Dharmesh Vitthaldas Shah (45) and Iqbal Shaikh (65), a resident of MG Road, Pune are the names of the accused. Ajay Amarlal Darda (45), a resident of Nana Peth has filed a complaint in this matter. Accordingly, the police have registered a case under IPC sections 406, 420, 34, MOFA Act Section 3, 4, 5, 8, and 13.
According to the information given by the police, Dharmesh Shah and Iqbal Shaikh are partners of Sanghvi Shah Associates and the firm. They had stipulated in the agreement to construct three floors in an area of 251.53 sq ft in City Survey No 563 C and 636.63 sq ft in 563 D. They reportedly started the construction on the fourth floor without taking the consent of the members of the society.
Though it is mandatory to transfer the premises and building of the society in the name of the organization, this transfer has not been done till now. A complaint was filed in court in this regard. After the court ordered the Samarth police to register a case and investigate, a case was registered and the investigation is going on in this regard.
