Pune: NGT Orders Swift Action on Forest Conservation in NIBM Annex Area After Complaint Published by Punekar News
Pune, 28th January 2025: The National Green Tribunal’s (NGT) Western Zone Bench in Pune has directed authorities to expedite measures for soil and water conservation in the forest area of Mohammedwadi, following a complaint raised by a resident of NIBM Annex, Jaymala Dhankikar, and published in Punekar News on September 11, 2024.
During the hearing held on January 27, 2025, the NGT reviewed submissions by the Principal Chief Conservator of Forests (PCCF) and the Ministry of Environment, Forest and Climate Change (MoEF&CC). The complaint highlighted concerns over forest destruction, soil erosion, and the damaged boundary wall in the reserved forest area.
Key Findings:
- No Evidence of Forest Destruction: The PCCF submitted that during a site visit, no signs of forest destruction or illegal mining were found. However, rainwater erosion and soil runoff from the forest area were identified as significant issues impacting the nearby residential society and roads in Mohammedwadi.
- Soil Erosion and Groundwater Concerns: The complainant noted that rainwater and soil runoff during monsoons cause mud accumulation and prevent groundwater recharge. She urged the Forest Department to implement soil conservation measures under the “Paani Adva Paani Jirva” scheme.
- Damaged Boundary Wall: The forest department reported that the boundary wall on the hill slope had been dismantled due to rainwater damage, but efforts are underway to reconstruct it and prevent further soil erosion.
- Budget Proposal: The PCCF stated that a budget proposal for soil and water conservation works in the hill slope area has been submitted for the 2024-25 fiscal year.
Tribunal’s Directives:
The NGT expressed disappointment over attempts to conceal parts of the affidavit filed by the PCCF. It warned the counsel to ensure full transparency in future filings.
The tribunal directed the Forest Department to prioritize and complete all conservation measures before the upcoming monsoon season. It also instructed the authorities to address the complainant’s concerns comprehensively.
Observations on Government Participation:
The tribunal noted that while the MoEF&CC acknowledged the issue as a state subject, no representative from the Pune District Magistrate’s office appeared for the hearing or submitted a reply affidavit.
Speaking to Punekar News, social worker Dhankikar said, “The Supreme Court-appointed Central Empowered Committee (CEC) report in 2007 is a mirror reflection of the NIBM – Kondhwa forest area, exposing the blatant disregard for environmental norms and the devastating impact of human activities on our ecosystem. We welcome the decision by the National Green Tribunal (NGT) and hope that the forest department will walk the talk, fulfilling the long-standing demands of area residents and implementing the NGT order in letter and spirit. It’s time for us to reclaim our forest and restore its former glory, ensuring a sustainable future for generations to come.”
