Bombay High Court Directs Private Schools to Submit RTE Admission Details Amid Legal Challenge
Mumbai, 18th June 2024: The Bombay High Court directed private unaided schools on Tuesday to provide admission details to the state government by a specified deadline. This directive follows their challenge against a recent notification from the state government imposing RTE Act quotas under specific conditions.
The court instructed the state to submit a comprehensive response to petitions and intervention applications contesting the February 9 notification. This notification exempted only private schools located within a 1km radius of government or aided schools from RTE admissions.
Highlighting the urgency of resolving the issue and ensuring that students are not left uncertain about their admissions, the bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Amit Borkar scheduled the next hearing for next month.
Earlier, on May 6, the High Court had halted the implementation of the notification until further notice. During Tuesday’s proceedings, several schools sought to intervene in the case as affected parties. The court granted their intervention and instructed them to file their affidavits in response to the main Public Interest Litigation (PIL) challenging the state’s policy.
