New Delhi, 15th April 2024: A petition has been filed in the Supreme Court seeking reconsideration of the decision made on February 15, which had invalidated the Modi Government’s electoral bond scheme. Advocate Mathews J. Nedumpara, who filed the reconsideration petition, stated that the court had considered the petition against the scheme. The court decided against the scheme without giving due consideration to the fact that it was acting as an appellate authority over the Parliament. The petition argues that the court exercised its discretion in a matter that falls within the specific domain of legislative and executive policy. Nedumpara claimed in his petition that the court failed to pay attention to the possibility that public opinion on this matter could vary. Most people in this country may possibly support this scheme, which has been brought into existence by their elected representatives. Apart from those who filed the petition, they also have the right to be heard. It is known that a five-judge Constitution Bench chaired by Chief Justice Dipak Misra had invalidated the electoral bond scheme on February 15, 2018. The Constitution Bench had declared the scheme a violation of freedom of expression and the right to information.
