Pune Builder Couple Booked for Flat Buyer Cheating at Lotus Court Project
Pune, 22nd August 2026: Chandan Nagar Police have filed a case against a builder couple linked to M/s Krishna Construction following a complaint alleging cheating and violations of commitments made to homebuyers at the Lotus Court residential project on Old Kharadi-Mundhwa Road.
The accused have been identified as Mittal Pranjivan Mistry (50) and Shikha Mittal Mistry (47), residents of Kalyani Nagar. The complaint was filed by Umesh Sandipan Magar (42), who owns a flat in the project.
According to the police complaint, the developers allegedly failed to deliver amenities promised to flat purchasers and misused consent letters and other documents obtained from residents. The complaint also alleges that modifications were made to the approved building plan and that two additional floors were constructed and sold without obtaining the consent of 110 flat owners.
The developers have also been accused of dealing with parking spaces in a manner contrary to the commitments made to buyers.
Magar told police that he booked a 2-BHK apartment measuring 921.07 sq ft, along with a parking space, in December 2018 for ₹80.86 lakh. The developers had allegedly assured him that possession would be handed over by December 2021.
The complainant stated that he paid ₹78,81,348 towards the flat through a combination of bank finance and personal funds. However, possession was not provided within the promised timeframe, he alleged.
According to Magar, he eventually received possession in October 2023 after approaching the police and subsequently signing a consent letter.
Chandan Nagar Police have registered the case under Sections 420 (cheating), 406 (criminal breach of trust), 506 (criminal intimidation) and 34 (common intention) of the Indian Penal Code, along with Section 7 of the Maharashtra Ownership Flats Act (MOFA).
