Pune: Four Model Colony Society Members Move Court Against Kotibhaskar Over Redevelopment
Shivajinagar, 9th August 2026: A redevelopment dispute involving Neelratna Sahakari Gruha Rachana Sanstha Maryadit on Lakaki Road in Model Colony has reached the Civil Judge, Junior Division, Pune, with four members seeking legal protection against the developer involved in the project.
Sagar Digambar Kolhe, Prabhavati Digambar Kolhe, Prashant Digambar Kolhe and Vaishali Sanjay Bhirud have filed proceedings against M/s Kotibhaskar Infrastructure & Developers Pvt Ltd, seeking an order preventing their alleged dispossession from the property.
The four plaintiffs have also asked the court to stop the developer from carrying out further redevelopment work or creating any third-party interests in the property until the dispute is adjudicated.
A key issue raised in the civil proceedings concerns the constitution of the society’s managing committee. The plaintiffs have alleged that the committee was formed without following the procedure prescribed under the Maharashtra Co-operative Societies (Election to Committee) Rules, 2014.
They have also disputed resolutions and other documents connected with the proposed redevelopment. According to their claims before the court, they neither signed the redevelopment memorandum of understanding (MOU) nor gave written consent authorising the developer to proceed with the project.
The latest case comes against the backdrop of earlier litigation before the Co-operative Court. In February 2025, the Co-operative Court passed an interim order in proceedings initiated by the society against the four members.
Documents submitted during those proceedings indicate that Kotibhaskar Infrastructure & Developers Pvt Ltd was selected as the developer after receiving 17 votes during the society’s redevelopment process.
The fresh civil proceedings have therefore added another dimension to the dispute, with questions now before the court regarding the society’s managing committee, the redevelopment process and the rights of individual members.
The allegations raised by the plaintiffs are subject to adjudication, and the latest proceedings will determine whether the reliefs sought against the developer can be granted. The matter is pending before the Civil Judge, Junior Division, Pune.
