Pune Police Did Not Follow Procedure To Arrest Youth For Making Threat Calls To Bhujbal And Munde, Court Orders Release
Pune 14th July 2023: The local court on Thursday termed the arrest of accused in a case related to threat calls to Minister Chhagan Bhujbal and Dhananjay Munde illegal and ordered the Pune City Police to release him.
It has been alleged that the police did not follow proper legal procedures while arresting the accused in this case. The courts pointed out that due process was not followed before making an arrest and hence the accused was granted bail on the surety amount of Rs 15,000.
According to the verdict issued by the Supreme Court in case of Bihar Vs Arnesh Kumar, it is necessary to serve a notice to the accused before making an arrest in a case having seven years imprisonment as punishment. Furthermore, in order to investigate and arrest the accused in a non-cognizable offense, the permission of the first-class judicial magistrate court is required. Both these procedures were not followed by the police due to which the arrest was illegal, said Advocate Sachin Salunkhe.
After hearing both the sides, the court granted bail to the accused. It may be noted that Prashant Dasharath Patil (24) a resident of Kolhapur was arrested from Mahad, Raigad by Pune Police. He was arrested for making threat calls to ministers and NCP leaders Chhagan Bhujbal and Dhananjay Munde. It was revealed later that Patil was drunk when he made calls and was angry on the two leaders joining BJP led government with Ajit Pawar.
