Pune Student Cleared NIOS Level-B Exam, But Certificate Delayed: Bombay High Court Directs JNV to Admit Him to Class VI
Pune, 12th August 2026: The Bombay High Court has directed PM Shri Jawahar Navodaya Vidyalaya, Pimpale Jagatap, Pune, to allow a student to attend Class VI for the 2026–27 academic year after he cleared the National Institute of Open Schooling (NIOS) Level-B examination but was awaiting the formal certificate.
The order was passed on August 10, 2026, by a Division Bench comprising Justice R. I. Chagla and Justice Firdosh P. Pooniwalla in Writ Petition No. 5517 of 2026.
The Court directed the school to permit the petitioner to attend Class VI and appear for examinations conducted by the school. His admission, however, will remain subject to submission of the Level-B Certificate once it is issued by NIOS.
The petitioner had appeared for the Level-B examination for the 2025–26 academic year following earlier directions of the Court and subsequently cleared the examination. However, the 2026–27 academic year had already commenced, and the student had been unable to attend classes. The school was awaiting the Level-B Certificate before proceeding with his admission.
During the hearing, counsel appearing for NIOS informed the Court that the Level-B Certificate would be issued within one week. The Court accepted the statement.
The Court also addressed the additional information sought by the school. It recorded that, according to the school’s prospectus for Class VI admissions for the 2026–27 academic year, there was no requirement to provide the information sought apart from the Level-B Certificate issued by NIOS.
The writ petition was subsequently disposed of, with the Court making no order as to costs.
The case was filed by students’ father Prashant Govind Bhapkar. Advocate Mayur Suhas Garud appeared with Advocate Harshvardhan Melanta for the petitioner.
