Court Orders Woman to Vacate Parents-in-law’s Bungalow due to Elderly Abuse

Pune,18th August 2023 – In a significant ruling, a Pune court has directed a woman to vacate her elderly parents-in-law’s bungalow within 15 days after finding her guilty of subjecting them to physical and mental abuse for financial gain. Judicial First Class Magistrate (JFMC) C.P. Shelke issued the order, highlighting the need to protect the rights and well-being of senior citizens.

The case unfolded as the woman filed a complaint against her in-laws and husband under the Domestic Violence Act, demanding a house and a monthly alimony of Rs 1 lakh. The court initially granted her a room in the family bungalow to reside in while the alimony matter remained unresolved. However, despite being directed by the court in August 2022 to treat her elderly parents-in-law with respect, the woman continued to mistreat them and extort money from them.

Given the severity of the situation, and with her husband residing in the USA since January 2022, the court decided to intervene to protect the well-being of the elderly parents-in-law. The couple had no children, and the woman, though a qualified doctor, had not been practicing medicine.

Advocate Sagar Bhosale, representing the parents-in-law, argued that senior citizens have a right to a peaceful life, and ill-treatment by a daughter-in-law should not be tolerated. Citing a high court precedent, Bhosale emphasized the importance of ensuring a safe and nurturing environment for the elderly. “We referred to a high court decision during the hearing of the application. We told the court that the parents-in-law were fed with their daughter-in-law’s torture,” he stated.

In response to the situation, the court not only ordered the woman to vacate the bungalow but also directed her husband to provide her with a monthly rental allowance of Rs 25,000. This measure was aimed at ensuring that the woman did not become homeless and had a stable living arrangement.
