Pune: Dispute Emerges Between TCS e-Serve and Employee Over Discharge and Pending Dues
Pune, 5th September 2025: A conflict has surfaced between TCS e-Serve International Ltd. and one of its employees, Khushal Pillay, after the company issued him a discharge letter citing misconduct and unauthorized absence. Pillay, however, has refused to accept the termination until his pending dues and compensation are cleared.
According to the discharge letter dated September 3, 2025, Pillay, who joined the company in December 2021 as a Senior Process Associate, was found guilty of prolonged unauthorized absence and indiscipline following an internal enquiry. The letter, signed by the Senior General Manager of Human Resources, stated that:
The enquiry concluded Pillay had been absent without authorization while continuing to fill timesheets.
Based on the findings, the company decided to discharge him with immediate effect, without notice or notice pay.
Salary already paid for the period of unauthorized absence would be recovered through his Full and Final Settlement (FFS).
Remaining dues would only be released once Pillay surrendered all company assets, including his ID card, laptop, and other items listed in an annexure.
The company also warned that failure to return assets within 24 hours could lead to recovery of costs from his FFS and potential legal action.
Employee’s Response:
In an email sent on September 4, Pillay acknowledged receiving the discharge letter but strongly contested its terms. He wrote, “I hereby state that I do not accept this discharge until my pending compensation and dues are fully released to me. It is unfair and unlawful to issue a discharge while withholding my rightful payments. I request the immediate release of my compensation, failing which I will be compelled to escalate this matter legally and pursue appropriate remedies.”
Pillay demanded a resolution on priority, emphasizing that he considered the discharge invalid without settlement of his dues.
