Pune: Bombay HC Directs EuroSchool Undri to Immediately Admit Child Under 25% RTE Quota
Mumbai/Pune, 1st August 2026: The Bombay High Court has directed EuroSchool Undri to immediately grant Grade I admission to a minor under the 25% reservation quota provided by the Right of Children to Free and Compulsory Education Act, 2009, and allow him to attend classes without delay.
A division bench of Justices R.I. Chagla and Farhan P. Dubash passed the consent order on July 30 while disposing of Writ Petition No. 7749 of 2026.
The petition was filed by the child through his mother, seeking directions against the Maharashtra government and other respondents, particularly the school, to grant him admission under the RTE quota.
The court noted that the matter had been heard at length over several hearings. With the assistance of all parties, mutually agreed terms were presented before the bench.
Under the consent terms, the child’s mother must withdraw all criminal and other complaints, including representations submitted to statutory and other authorities concerning her son’s admission to the school. The complaints must be withdrawn immediately and no later than August 7, 2026.
The court also recorded a statement that the child and his mother had expressed regret over an incident that occurred on the school premises on June 16. The order did not provide details of the incident.
The school was directed to immediately admit the child to Grade I and permit him to begin attending classes.
The bench clarified that the order would not prevent the school from raising concerns in the future over documents submitted by other applicants seeking admission under the 25% RTE quota.
The writ petition was disposed of without any order regarding costs.
Under Section 12(1)(c) of the RTE Act, specified schools must admit children from weaker sections and disadvantaged groups to at least 25% of their Class I seats and provide them with free and compulsory elementary education.
