Bombay HC Issues Contempt Notice To Pune Cop For ‘Malicious Prosecution’ Against A Man

Pune 12th July 2023: The Bombay High Court has issued a contempt notice to a policeman attached with Hinjewadi Police Station in connection with a case registered in 2012. The court accused him of ‘malicious prosecution’ against a National Defence Academy (NDA) professor in a case related to forgery.
The court further asked the accused to explain as to why he should not be directed to pay Rs 10 lakh compensation to the victim. Assistant Police Inspector Anand M Pagare who was posted at the Hinjewadi police station was investigating a case related to a professor at NDA over alleged charges of forging his disability certificate.
The professor had submitted a disability certificate issued by Sassoon General Hospital to the NDA. However, when it was sent for the verification the hospital authorities could not find the original record in 2012. Accordingly, a case in this regard was registered at Hinjewadi police station.
However, the hospital officials later informed the Investigation Officer (IO) after they traced the original record of the professor’s certificate in 2016. Despite this, the police did not mention this in the charge sheet filed before the court in 2017. The professor approached the court seeking quashing of the FIR in the matter.
The High Court has asked the API to physically remain present in the court and has also issued a show cause notice to him.
