Delhi: District Court Stays Proceedings Amid Serious Allegations of Abuse of Legal Process by Vikas Garg
New Delhi, 9th June 2026: In a significant development, the Principal District & Sessions Judge (West), Delhi, has stayed proceedings in matters pending before the Court of the Learned JMFC-01, Tis Hazari Courts, after hearing serious concerns regarding the fairness of the proceedings and allegations that the judicial process was being used as a tool of harassment and pressure.
The applicants approached the District Court seeking transfer of multiple proceedings initiated by or on behalf of Vikas Garg and entities associated with him. They contended that the manner in which these cases were being listed and pursued had created a genuine apprehension that the accused persons would not receive a fair and impartial hearing.
During the hearing, the applicants highlighted what they described as a pattern of conduct by Vikas Garg involving the use of legal proceedings to exert pressure on individuals and entities. Reliance was placed on judicial orders passed in other proceedings where allegations had been made regarding inducement of investors, coercive tactics, intimidation and misuse of legal processes.
The applicants further pointed to complaints in which confidential financial records of third parties, having no apparent connection with the alleged offences, were sought through criminal proceedings. According to the applicants, such actions demonstrated an attempt to use the criminal justice system for purposes beyond legitimate prosecution.
Significantly, concerns were also raised regarding the unusual frequency with which matters connected to Vikas Garg and his associated entities were being listed before the Trial Court. The applicants submitted that this pattern gave rise to a legitimate apprehension that the ordinary course of justice was being influenced in a manner prejudicial to the accused.
The Principal District Court found the issues raised serious enough to issue notice, call for the Trial Court Record, seek comments from the concerned Presiding Officer in a sealed cover, and most importantly, stay all further proceedings before the Trial Court until further consideration of the transfer petitions.
The stay order assumes particular significance because it reflects judicial recognition that the concerns raised by the applicants warrant closer examination before the proceedings are permitted to continue.
According to the applicants, the interim relief granted by the District Court has brought into focus longstanding concerns regarding the alleged misuse of legal processes by Vikas Garg and his associates. They maintain that the stay order serves as an important safeguard against any attempt to undermine the fairness and integrity of judicial proceedings.
The matter is now listed before the Principal District & Sessions Judge (West) on 31 July 2026.
The applicants have expressed confidence that the judicial process will ensure that all proceedings are conducted fairly, transparently and without any external influence, thereby preserving public confidence in the administration of justice.
