FIVE YEARS RIGOROUS IMPRISONMENT TO THEN INSPECTOR (SHO) OF DELHI POLICE

New Delhi: The ASJ, Tis Hazari Courts, Delhi has today sentenced Sh. Dharam Pal Yadav, Inspector (Retd), the then SHO Police Station Hauz Qazi, Delhi to undergo five years Rigorous Imprisonment with fine of Rs.35,000/- in a case relating to custodial death of Sh. Hari Shankar, resident of Delhi.

CBI had registered the case on 17.04.1998 against Inspector Dharam Pal Yadav, SHO Police Station Hauz Qazi, Delhi and others, on the request of Government of NCT, Delhi and further notification from Government of India. The complainant (brother of the deceased) alleged that his brother was tortured and killed by police personnel of Police Station, Hauz Qazi, Delhi. It was further alleged that Sh. Hari Shankar, resident of Chowk Shah Mubarak, Delhi was picked up by police personnel of Police Station, Hauz Qazi, Delhi on 09.12.1997 on the instructions of Inspector Dharam Pal Yadav, SHO and was mercilessly beaten. As a result, he died on 10.12.1997 while in Police custody.

After thorough investigation, CBI filed chargesheet on 10.12.1999 in the Court of CMM, Tis Hazari Courts, Delhi against two accused i.e. Inspector Dharam Pal Yadav, then SHO and then ASI of the said Police Station. The then ASI expired during trial and charges against him were abated. 24 prosecution witnesses were examined.
The Trial Court found the accused guilty and convicted him.
