Lawyers demand attempt to murder case against Pune police constables for assaulting women vendors

Pune, July 11, 2019 : Adv Tosif Shaikh and Adv Kranti Sahane from Advocacy Association have sent a letter to senior police inspector in-charge of Hadapsar police station, Pune city police, demanding registration of FIR against police constables who brutally assaulted two women on July 9 during anti-encroachment drive.

The letter dated July 10 states, “That with respect to an incident which occurred under your jurisdiction at near Kumar Paradise on road from Magarpatta City to Laxmi Lawns, Hadapsar. At around 5.30 pm on July 9 an old woman and her daughter-in-law were brutally, inhumanly assaulted by Pune city police personnel while taking them away for illegally putting up a tea stall near Magarpatta City, Hadapsar. It is very pitiful, injudicious and unwise on your part to register FIR vide no. 628/2019 under section 353, 504, 506 read with section 34 of the Indian Penal Code, 1860 inspite of the fact that the said old lady was were brutally, inhumanly assaulted by group of more than 5 police personnel to such an extent that the old lady fell unconscious on ground due to the said beating.”

The letter further stated, “The video of the said incident has gone viral on social media in which women constables are clearly seen beating the old lady and were also seen pulling hair of old lady and also one lady constable trying to disrobe the saree of the old lady, that the said old lady was assaulted beaten so brutally and inhumanly that she is seen falling unconscious on ground. This is very shameful and condemnable act. As a citizen of India we hereby request you to consider this as complaint under section 154 CrPC, 1973, and register FIR under section 307, 354(B) r/w 34 and others of the Indian Penal Code, 1860 and arrest the concerned accused.”

A woman and her daughter-in-law were brutally assaulted by Pune city police personnel while taking them away for illegally putting up a tea stall near Magarpatta City, Hadapsar. Later, an FIR was registered against them for obstructing public servant from discharging official duty. A video of the incident has gone viral on social media.

The incident took place around 5.30 pm on July 9 near Kumar Paradaise on road from Magarpatta City to Laxmi Lawns. During anti-encroachment drive by Pune Municipal Corporation (PMC), police personnel were seen beating them while arresting them. The women constables were also seen pulling hair of one of the woman.

Later cops booked Lata Hake and Gangubai Hake for obstructing them from discharging their official duty. As per the FIR, the women abused the cops and also tried to self-immolate infront of their vehicle.

The women have been charged by police for offences under sections 353 (obstructing public servant from discharging official duty), 504 (intentional insult), 506 (criminal intimidation), 34 (common intention) of the Indian Penal Code (IPC).
