Pune Builder Sentenced One Year In Jail For Delay In Giving Possession Of Flat

Pune, 14th September 2021: The Consumer Disputes Redressal Commission has convicted a builder and sentenced him to one year in jail for a delay of 30 years in giving possession of a flat.

Mahendra Chhagpal Karia of M/s Karia Builders has been ordered to undergo simple imprisonment for one year and Rs 10,000 fine.

In 1990, Shobha Bhagde and Harish Bhagde from Ganesh Peth had booked two flats in A-wing building in ‘Konark Classic’ society on Bundgarden Road for Rs 3.5 lakh. However, the builder M/s Karia Builders failed to deliver possession of flat numbers 4 and 5.

Bhagde had moved the consumer forum which had ordered in 2001 to give the possession of the flats after receiving the balance consideration with interest at 24% per annum from the date of installments till the date of payment and to execute the registered sale deed. There was another option to refund all the amount with 9% interest.

However, the complainants again failed to get possession of flats though they were ready to pay the remaining amount.

In 2016, the complainants had moved the consumer disputes commission which again directed the builder to hand over the flats. The builder had challenged this order before the Bombay High Court which rejected his plea.

Considering all the facts, the district consumer disputes commission convicted the builder and sentenced him to undergo one-year imprisonment.
