Pune: Consumers Struggle For Justice As Consumer Commission Orders Not Complied On Time

Pune, 24th December 2024: Despite receiving favorable verdicts from the Consumer Commission, many consumers are left disappointed as service providers often fail to comply with compensation orders. This has forced consumers to embark on a prolonged battle for justice, even after the initial ruling.
The Consumer Commission was established to provide a swift resolution for consumers who face fraud or deficiencies in service. Pune district has two consumer commissions, and cases of fraud committed by manufacturing companies, insurance firms, or tourism agencies are routinely brought before them. After hearing the claims and arguments, the commission issues its verdicts, which often bring relief to aggrieved consumers.
However, the process of ensuring that these orders are implemented has proven challenging. Many service providers, particularly those from industries such as construction, insurance, and tourism, fail to comply with the compensation orders. In several cases, these companies appeal the verdicts, taking the matter to higher commissions such as the State Commission or even the National Consumer Disputes Redressal Commission (NCDRC).
The primary reason for these appeals is often the financial implications of the compensation. Companies facing multiple complaints may have to pay significant amounts in damages, prompting them to seek legal recourse to delay or reduce their liabilities. This results in additional legal battles, prolonging the consumers’ struggle and causing mental distress.
In cases where service providers do not comply with the commission’s orders, consumers are forced to initiate a new implementation process. Under Sections 71 and 72 of the Consumer Protection Act, they can file an application to enforce the ruling. However, the process is often cumbersome and time-consuming, leaving many consumers frustrated.
On National Consumer Day, observed on 24th December, these challenges highlight the gaps in the consumer protection system. While consumer commissions provide a platform for justice, the lack of effective mechanisms to ensure timely compliance with their orders undermines their purpose. For many consumers, the fight does not end with a favorable verdict—it is merely the beginning of another arduous battle.
Advocates for consumer rights are calling for stricter enforcement mechanisms to hold companies accountable and to ensure that justice is not delayed for those who have already suffered at the hands of negligent or fraudulent service providers.
