Pune, 12th January 2023: The Labour Commissioner’s Office, Pune, has sent a notice to E-commerce giant Amazon regarding the implementation of an illegal Voluntary Separation Policy and layoffs. The Labour Department has asked the Amazon management to be present on 17th January.
According to Nascent Information Technology Employees Senate (NITES), an association of IT employees, which has filed the complaint, the livelihood of 1000s of employees and their families has now been made vulnerable. “As per procedures laid down under Industrial Dispute Act, the employer cannot, without prior permission from the appropriate government, layoff an employee featuring on the muster rolls of the establishment,” said NITES president Harpreet Singh Saluja.
He added, “It is pertinent to note that a worker who has served for at least a year of continuous service cannot be retrenched unless served a notice three months in advance and prior permission from the appropriate government. The said application has to be submitted by the employer along with the reasons for such retrenchment. The said application shall be taken into consideration and scrutinized through an inquiry. However, Amazon has violated the existing provisions of Indian labour laws, which aim at protecting workers’ rights. The voluntary separation policy implemented was never submitted to the Labour Ministry for review, which is a violation of existing Labour laws.”
Based on the complaint, Assistant Labour Commissioner GS Shinde has asked the Amazon Manager to appear before him at 3 pm on 17th January.
