Pune : MACT Awards Rs 1.18 Crore to Widow and Mother of Tax Consultant Killed by Cement Mixer Truck

Pune, 22nd August 2026: The Motor Accident Claims Tribunal (MACT), Pune, has directed the owner and insurer of a cement mixer truck to jointly pay Rs 1,18,16,556 with 7% interest to the widow and mother of 32-year-old tax consultant Makarand Gopal Jinde, who died on the spot in a road accident on April 25, 2023.

Member S.R. Pawar held that the driver of truck MH-43 U 6695 was negligent. The vehicle, owned by S & J Buildcon Pvt Ltd and insured with HDFC ERGO General Insurance, dashed into Jinde’s motorcycle from behind on Jambhulwadi-Shivajinagar Road near Shivajinagar Chowk around 1:30 pm and ran over him. Crime was registered against the driver under relevant IPC and Motor Vehicles Act sections.

The tribunal rejected claims of contributory negligence by the deceased, noting the truck driver’s higher duty of care and the prosecution pending against him. It accepted the involvement of the truck and cause of death as multiple injuries.

Jinde’s annual income was fixed at Rs 7,82,449 by averaging the gross total income shown in his income-tax returns for assessment years 2020-21 to 2022-23. Applying a 40% addition for future prospects, one-third deduction for personal expenses, and a multiplier of 16, the loss of dependency was calculated at Rs 1,16,84,556. Enhanced conventional heads (funeral expenses, loss of estate and consortium for two dependents) added another Rs 1,32,000.

Only the widow (Neha Makarand Jinde) and mother (Ambika Gopal Jinde) were held entitled; the brother was excluded as he is not a Class-I heir and was not dependent. The amount is to be equally shared between the two successful claimants. The petition, filed under Section 166 of the Motor Vehicles Act, was partly allowed with proportionate costs. The opponents must deposit the sum in the tribunal’s designated bank account. The judgment was delivered on August 18, 2026.
