Pune: MACT Orders Insurance Company To Pay Rs 58.5 Lakh Compensation To Road Accident Victim’s Family

Pune, 22nd May 2023: The Motor Accident Claim Tribunal (MACT) has directed the New India Insurance Company to pay a compensation amount of Rs 58,52,673 to the family of a businessman who lost his life in a tragic accident involving a speeding tempo. The judgment was delivered by a Member of the Tribunal, Judge S. B. Hedau.

The claim was filed at the MACT by the wife, three children, and mother of the deceased businessman through their legal representatives, Adv. N. D. Washimbaker and Adv. J. K. Basale. The tribunal’s order states that the insurance company is liable to pay the compensation amount along with an annual interest of seven percent from the date of filing the claim.

The unfortunate incident occurred on 22nd May 2017 when the 42-year-old businessman was crossing the Pune-Ahmednagar road and was struck by a speeding tempo. He sustained severe injuries and was immediately rushed to a private hospital for medical treatment. Despite the best efforts of the medical staff, he succumbed to his injuries on 28th May 2017.

Subsequently, in June 2017, the family of the deceased businessman filed a claim for compensation. It was revealed during the proceedings that the deceased had an annual income of Rs 5,25,988 from his tours and travels business. Advocates Washimbaker and Basale argued for a higher compensation considering his income, age, and dependents. The court accepted their plea and issued the order for a compensation amount of Rs 58,52,673 to be paid to the family, with an interest rate of seven percent per annum.
