Pune: Uninsured Four-Wheeler Collides with Bike, Settlement Reached in Compensation Suit In Two Days

Pune, 8th May 2024: One person lost his life in an accident involving a speeding four-wheeler colliding with a two-wheeler. Following this incident, the deceased youth’s parents filed a compensation suit at the Motor Accident Claims Tribunal (MACT).

However, it was discovered that the four-wheeler involved in the accident was not insured. Consequently, the claim was directed against the car owner. After reaching a compromise through the Tribunal court, the case was settled only on the second hearing date.

The owner of the four-wheeler provided Rs 5 lakh as compensation to the deceased’s family. Representing the applicants’ parents were Adv. Onkar Rawde and Adv. Prachi Jog, while Adv. Amit Rathi and Adv. Avinash Pawar represented the car owner. They were supported by Adv. Poonam Mavani and Adv. Aditya Jadhav.

This incident occurred on 19th July 2023, in front of the ARDE gate at Pashan, around 8:30 pm. Two youths were riding a bike when a speeding four-wheeler collided with their two-wheeler. Bike rider Rohan Dhanraj Gaikwad lost his life in the accident.

A case was subsequently registered against the driver under IPC section 304 (punishment for culpable homicide not amounting to murder) at Chaturshringi Police Station. Following this accidental death, the parents of the deceased child filed an application with the Tribunal seeking compensation.

However, as the car involved in the accident was uninsured, a claim was instead filed against the car owner. The matter was then referred to the mediation court.

After mediation between the applicant and the vehicle owner before the Additional Chief Judicial Magistrate JS Bhatia, the claim was settled on the second hearing date by paying Rs 5 lakh.
