Pune: Consumer Forums Order Kesari Tours To Refund Rs 55,000 Advance Booking Amount As Trip Was Cancelled
Pune, 28th September 2022: The Pune District Consumer Disputes Redressal Commission has directed Kesari Tours Pvt Ltd to refund Rs 55,000 advance booking amount with 9% interest since 2014 as the planned honeymoon trip had to be cancelled due to a death in the family. The consumer forum has also ordered the tours and travel company to pay Rs 10,000 for mental agony and litigation cost.
A man from Sasanenagar in Hadapsar had approached the company on
15th April 2014 enquiring about honeymoon tour package as his marriage was on 11th May 2014. He liked the Shimla Kullu Manali tour which was planned on 19th May 2014 for Rs 77,260. The complainant agreed with the package and price of the entire tour and booked the said tour by paying an advance of Rs 55,000.
The wedding preparation was going on. However, the grandmother of the complainant got seriously ill and expired just a few hours before the wedding. He informed the company and asked them to keep the amount for a future tour.
The complainant waited for one and a half years, but Kesari Tours
did not give him any tour. They cancelled the trip in June 2015, without informing the complainant and did not refund the advance amount to the complainant to date.
According to the company, on the request of the complainant, the
the company informed him that the Opposite Party does not have another departure for the same month and the Opposite Party cannot postpone the said departure and, therefore, to avail the future tour. The complainant has to cancel the said tour as per the terms and conditions of booking a tour and keeping the remaining amount for a future tour so that he can travel at any time.
After confirming the same with the complainant, the company cancelled the booking and as per terms and conditions of booking tour. The complany informed the complainant that, as per rule, cancellation charges will be 60% amounting to Rs 46,359. It is denied by the company that they avoided refunding the tour cost to the complainant and states that his journey was by air. The company was waiting for air cancellation charges from airlines. They also informed the complainant that as soon as they receive air cancellation charges from airlines, they will refund the same to him.
The complainant wanted to keep the amount for a future tour. At that
time, the company explained to him that for booking a future tour, he needed to cancel this tour as the company has already made all the arrangements for the tour and services such as air tickets, hotel booking etc., for which the company has made payment to suppliers. The services have to be booked in advance so that the promised services will be given to guests and they can enjoy the tour to the full extent. Therefore, if the complainant cancels the tour at the last moment, mere 06 days before departure, which led the company heavy cancellation charges from suppliers. Therefore, the complainant has to bear the cancellation charges and he can keep the remaining amount.
