Battle for Serenity: Pune’s Kalyani Nagar Residents Fight Against Nuisance-Causing Rooftop Dining

Pune, 16th June 2023: Local residents living near a rooftop/open terrace restaurant situated in Cerebrum IT Park, above DMART Kalyani Nagar, have raised serious concerns regarding the establishment’s persistent nuisance, specifically due to loud music played between 10 PM and 6 AM. 

The aggrieved residents have called for the cancellation of the restaurant’s license and lawful charges to be imposed on DJs and owners involved.

The main reasons for these concerns are as follows:

  1. Loud Noise/Music: The establishments in question, consistently operate late into the night, disregarding the Supreme Court’s guidelines on permissible decibel levels and time limits. The excessive noise generated by their booming speakers and amplifiers surpasses the legally acceptable limits, resulting in severe distress for the neighboring residents. Despite multiple complaints, no concrete action has been taken to address the issue. The persistent noise pollution poses various health risks, including sleep apnea and temporary deafness.
  2. Operational Hours: These establishments have been observed to continue serving alcohol beyond the authorized timings, yet no actions have been taken despite reporting the matter to the police and relevant authorities. Moreover, there have been reports of unauthorized use of electricity.
  3. Fire Hazard: The restaurants in question have been observed to employ firecrackers, posing a significant risk of fire incidents, especially considering the high occupancy levels. Conducting immediate fire audits at these establishments is crucial to prevent potential disasters, as demonstrated by the recent incident at Marigold IT Park on May 29, 2023, where 40 individuals had to be rescued from upper floors.
  4. Impact on Customers: Numerous vehicles leaving these restaurants often play loud music, disturbing the peace and attracting undesirable elements. The behavior of some patrons, including drunken driving, violent incidents, and public indecency, has also been a cause for concern. Instances of the sale and consumption of banned substances, discarded needles, and empty alcohol bottles in public areas have further intensified the need for action.
  5. Legal Violations: It has come to light that rooftop restaurants, such as the aforementioned establishments, are operating illegally without obtaining a No Objection Certificate from nearby societies. Concrete evidence, including video footage from the restaurant’s Instagram account showcasing loud music, has been submitted alongside the complaints.
  6. Lack of Action: Despite the police recommending the cancellation of license to the Pune Municipal Corporation (PMC) and Excise Department, no substantial measures have been taken to address the issue thus far.

The residents are also deeply concerned about the serving of alcohol to underage patrons, the availability of hookahs in these establishments, and the overall safety and security risks posed by unruly behavior from intoxicated individuals. The frequency of violent incidents and the intimidation faced by residents when they report such issues is alarming. The reckless behavior of patrons outside these establishments, including public consumption of alcohol and disruptive behavior, adds to the growing safety concerns.

Given the recent case of a young boy being brutally assaulted by individuals associated with these establishments, the rise in violence demands that commercial entities involved be held accountable and face severe consequences for their actions.

Residents are eagerly awaiting appropriate action from the authorities to address these ongoing issues, prioritize the well-being of the community, and restore peace to the affected neighborhoods.
