Buying Property in Maharashtra? New Land Titling Bill Aims to Prevent Fraud and Ownership Disputes
Pune, 14th July 2026: After remaining under discussion for nearly a decade, the Maharashtra government is set to introduce the long-awaited Maharashtra Land Titling Bill during the upcoming Winter Session of the state legislature in December. The proposed legislation aims to establish conclusive ownership of land and immovable properties, bringing greater transparency, security and efficiency to property transactions across the state.
The Bill proposes an authoritative land titling system under which the government will certify and maintain ownership records of land and immovable properties. Officials said the move is intended to strengthen property rights without affecting the existing ownership of landholders. By providing legally authenticated ownership records, the legislation is expected to reduce disputes, curb fraudulent transactions and boost confidence in the real estate sector.
The process of drafting the legislation began in 2014, when the Department of Land Records prepared the initial draft to ensure accurate property registration, prevent illegal land sales and provide guaranteed ownership rights. However, the proposal underwent multiple rounds of scrutiny after the Revenue Department and the Law and Judiciary Department recommended several amendments. As a result, the Bill remained pending for years before the state government recently decided to revive and fast-track the process.
Revenue Minister Chandrashekhar Bawankule has confirmed that the Bill will be tabled during the Winter Session of the Maharashtra Legislature.
At present, land records in India primarily capture details such as survey numbers, land classification, location and area. The proposed legislation seeks to expand the scope by enabling the accurate registration of buildings, apartments and other immovable properties. This is expected to reduce ambiguity in ownership records and minimise the risk of fraudulent property transactions.
The Bill also proposes greater transparency by making it mandatory to disclose any pending court cases or legal disputes related to a property at the time of its sale or transfer. Officials believe these provisions will help buyers make informed decisions while reducing litigation arising from disputed ownership.
The proposed framework draws inspiration from land titling systems followed in several developed countries, where the government guarantees ownership records instead of relying solely on historical property documents. If enacted, the Maharashtra Land Titling Act is expected to modernise the state’s land administration system, strengthen legal protection for property owners and streamline real estate transactions across Maharashtra.
