Over 10,000 Document Registrations Violated Maharera and Fragmentation Acts In Pune: Revenue Minister Vikhe Patil

Pune, 24th August 2023: “We have received two reports highlighting instances of registration violations under the Maharera and Fragmentation Acts. As a result, we are committed to taking appropriate actions in response,” declared Revenue Minister Radhakrishna Vikhe Patil on Thursday.

Patil emphasized that the registration of apartments within such developments should strictly adhere to the regulations set forth by the competent authority and include the requisite Maharera registration number. A circular, issued by the Inspector General of Registration, underscored the necessity to register transactions involving plots that have been approved for sale after layout approval and subsequent demolition.

However, a disconcerting revelation indicated that Pune city witnessed the registration of 10,561 units that violated both of these legal provisions. In light of this grave situation, the state government swiftly instigated disciplinary measures against 44 officers and staff members involved. Notably, this action led to the suspension of 11 sub-registrars, along with transfers of other officials, and the initiation of departmental inquiries.

Concurrently, an update emerged regarding a petition filed before the Aurangabad Bench of the Bombay High Court pertaining to the Fragmentation Act. This specific circular issued by the Inspector General of Registration was nullified by the court. Despite the state government’s subsequent pursuit of a review petition, success remained elusive. Consequently, the government has taken the matter to the Supreme Court, though a final verdict is yet to be reached. Meanwhile, in response to concerns surrounding the registration of documents in contravention of Maharera and the Fragmentation Act, Vikhe Patil conveyed intentions to enact suitable measures.

In relation to the breach of the Fragmentation Act, both reports have been meticulously examined, revealing significant irregularities. Swift and decisive action will be taken to address this issue promptly. The report from Registration Office No. 3 is currently pending and will be accessible in the near future, stated Radhakrishna Vikhe Patil, the Revenue Minister.
