Pune, 9th March 2023: A builder in Pune has been denied pre-arrest bail and has been ordered to be kept in custody after being accused of defrauding the beneficiaries of the Maharashtra Housing and Area Development Authority (MHADA).

The builder has been identified as Pankaj Prakash Yeola, a resident of Rahatani, Pimpri-Chinchwad, who owns Bhoomi Infracon. The case was registered at the Bundagarden police station.

According to government rules, developers are required to provide flats to MHADA under the low-income group on 20% of the total area. In May 2019, the lottery drawn by MHADA included the Bhoomi Blessings housing project presented by Pankaj Yeola of Bhoomi Infracon. The list of beneficiaries was released in June 2019 in the lottery conducted by MHADA. After signing the agreement between the beneficiary and the developer, 70 percent of the amount was received as compensation for the flat.

However, Yeola did not hand over possession of the flats to the beneficiaries by the agreed-upon date of September 20, 2020. As a result, the beneficiaries filed a complaint on December 11, 2020. Yeola was contacted by the chief officer of MHADA’s Pune office, and they had a meeting in which Yeola promised to give the beneficiaries possession of the flats before March 31, 2022. Despite this, Yeoala did not take any action, prompting the beneficiaries to give a notice to go on a fast. MHADA subsequently filed a complaint with the police.

The court’s decision to deny Yewala’s pre-arrest bail application and keep him in custody is a significant step towards ensuring that builders uphold their contractual obligations and deliver flats to beneficiaries in a timely manner. The case serves as a warning to other builders that they will be held accountable for their actions if they engage in fraudulent practices that harm low-income groups.
