Pune : HC Asks State Govt To Inform Whether It Intends To Withdraw Notification To Exclude Two Villages From PMC Limits

Pune 10th August 2023: The Bombay High Court on Wednesday has asked the state government to inform whether it intends to withdraw the notification dated March 31 this year to exclude Uruli Devachi and Phursungi villages from the Pune Municipal Corporation limits. This came after the petitioners claimed that the notification issued by the state government to exclude these two villages was illegal citing a similar case reported in Kalyan-Dombivali in which the order was passed by the high court earlier in 2020. The court also said it will take a decision on the matter if the government fails to respond.

The petitioners cited a similar case of 2020 in which the high court had directed the state government to withdraw its notification that excluded the villages from the municipal corporation limits. Earlier, a decision to exclude Uruli Devachi and Phursungi villages from the Municipal Corporation limits after the former MLA Vijay Shivtare approached the Chief Minister with villagers demanding that the two villages be made a separate municipal council and they should be excluded from the municipal corporation.

However, several residents approached the court against this order of the state government and said it was illegal. The citizens claimed that they will not have development facilities if they are excluded from PMC. The petitioners had claimed that the municipal commissioner’s consent should not be considered as a consent of the municipal commissioner as the civic body does not have elected representatives since the previous term ended in 2022 and there has been no fresh elections after that.

The court has kept the matter for further hearing for today and final verdict on the same is likely to be pronounced.
