Pune: Maharashtra Government To Protect Rights Of Flat Owners In Demolished Illegal Constructions

Pune, 5th March 2025: In a significant move, the Maharashtra government has announced that flat owners in unauthorized constructions will retain their rights even if the structures are demolished by planning authorities. The decision aims to safeguard buyers who suffer financial losses due to illegal constructions while ensuring accountability from landowners and developers.
The Urban Development Department has also directed planning authorities to halt any new construction on the site until the rights of affected flat owners are determined. This directive follows a High Court order that called for new guidelines to address unauthorized constructions on private lands.
Many citizens purchase flats in such constructions due to lower prices, often unaware of the legal complications. In most cases, they fail to get ownership transfer through a registered housing society, leaving them without legal proof of ownership. As a result, when demolition occurs, residents face financial loss and loss of property rights.
The new government notification aims to provide relief by ensuring that affected flat owners can claim their rights, preventing them from being left without compensation or recourse after demolitions. This move is expected to benefit economically weaker sections who unknowingly invest in unauthorized constructions.
