Pune: Motor Accident Tribunal Rejects Insurance Company’s Defence, Orders Rs 11 Lakh Compensation for Victim’s Family

Pune, 4th April 2023: The Motor Accident Claim Tribunal (MACT) has awarded a compensation of Rs 11 lakhs to the family of Ajitkumar Gangadhar Dhamal, who lost his life in a bike accident. The insurance company, ICICI Lombard General Insurance Company, had refused to pay compensation to the family on the grounds that the bike involved in the accident was not insured. However, the MACT rejected the insurance company’s claim and ordered compensation to be paid to Dhamal’s family.

Dhamal was riding his two-wheeler in the Sahkarnagar area of Pune on October 25, 2017, when he was hit by another two-wheeler driven by Akshay Nadkar. Dhamal sustained serious injuries and died during treatment. Following his death, his wife Shailaja and son Kshitij filed a compensation claim against Nadkar, Akshay Bharne, and ICICI Lombard General Insurance Company. Nadkar’s bike was not registered with the regional transport office on the day of the accident, and the insurance company argued that there was no insurance policy in place at that time.

However, the Tribunal rejected the insurance company’s defence, stating that the policy number, vehicle number, chassis number, and engine number mentioned in the policy taken by the applicant from the police station were the same. The Tribunal ordered the driver, owner, and the insurance company to pay Rs 10,87,528 to Dhamal’s family, along with an interest rate of eight percent from the date of filing the claim.
