Pune: PMC Issues Notice to Builder in Hadapsar Over Unauthorised Use of Building Without Occupancy Certificate
Hadapsar, 31st January 2026: The Pune Municipal Corporation’s (PMC) Hadapsar ward office has issued a notice seeking an explanation for the unauthorised use of a building in Hadapsar, where flats are allegedly being occupied without a mandatory Occupancy Certificate (OC).
According to civic officials, the notice was served after a complaint highlighted that the project was in use despite the developer not securing either a Completion Certificate or an Occupancy Certificate from the PMC.
Project Details and Allegations
The residential project is located at Sadesatra Nali, Hadapsar.
The complainant, Vinayak Joshi, had approached the PMC on January 23, 2026, alleging that possession of flats was handed over and residents had started living in the complex without the required approvals.

PMC Action and Legal Position
Following the complaint, the Hadapsar ward office carried out a preliminary verification and issued a notice to the developer and concerned parties, seeking a detailed explanation for the unauthorised occupation of the building.
The complaint also cited a Supreme Court ruling in the case of Dharmendra Sharma vs Agra Development Authority, which states that possession of flats without a Completion Certificate is illegal and not valid in the eyes of law.
What the Notice Demands
The PMC has asked the developer to clarify:
• Why the building is being used without an OC
• Under whose permission residents have started occupying the flats
• Why penal action should not be initiated under the Maharashtra Municipal Corporation Act
Civic officials said further action may follow if the explanation is found unsatisfactory.
