Pune: Woman Wins Relief In Consumer Forum Against Delayed Possession of Flat

Pune, 24th July 2023: The Additional District Consumer Grievance Redressal Commission has ruled in favor of a woman who filed a complaint against a developer for the delayed possession of her booked flat.

As per the commission’s order, the complainant woman must be given possession of the flat within three months. In case the possession is not provided within the specified timeframe, the developer will be liable to pay five thousand rupees per month to the woman.

The verdict was delivered by Commission Chairman Jayant Deshmukh and Members Shubhangi Dunakhe and Anil Khaibekar. The complaint was lodged by Vaishali Santosh Shelke, a resident of Gandharva Nagar in Moshi, against Dhanesh Maruti Thorat and Ajit Gyaneshwar Pawar, the partners of Dhruvraj Builders.

The developers were involved in a housing project in Moshi, wherein the complainant had purchased a flat worth Rs 19 lakh one thousand 760. She had already made a payment of Rs 16 lakh 98 thousand in cash to the developers.

As per the initial agreement, the developers had promised to hand over possession of the flat by October 2018. However, when the complainant did not receive possession till July 2022, she decided to approach the Consumer Commission. In the absence of the developer during the case proceedings, the commission issued a unilateral order.

As per the Commission’s directive, the developer is now required to pay Rs 25,000 as damages, Rs 5,000 as complaint costs, and ensure immediate, legal possession of the flat within three months from the date of judgment. Failure to do so will result in the developer having to pay five thousand rupees to the complainant every subsequent month until possession is handed over.
