Pimpri Chinchwad, November 7, 2020: Maharashtra Legislative Council Teachers’ and Graduates’ Constituencies biennial by-election 2020 has been announced. The model code of conduct will remain in place till the end of the election process. Voting will take place on December 1, 2020, and counting will take place on December 3, 2020. 

Therefore, Section 144 of the Code of Criminal Procedure (CrPC) 1973 has been imposed to ensure that law and order is not disturbed in the jurisdiction of the Pimpri-Chinchwad Police Commissionerate in order to conduct the by-elections in a smooth, peaceful and fearless and just manner.

Pimpri-Chinchwad Police Commissioner Krishna Prakash has informed that the order will remain in force till 12 noon on December 5, 2020, as per the powers vested under Section 144 of the Code of Criminal Procedure, 1973.

Seven members are elected from amongst graduates from seven divisions of Maharashtra (Mumbai, Amravati Division, Nashik Division, Aurangabad Division, Konkan Division, Nagpur Division and Pune Division).

Restrictions are being imposed on pasting pamphlets of the parties concerned in public places, cloth boards of symbols and giving speeches in public places during the election period. During the election period, any kind of processions, rallies, meetings, making any kind of announcements, playing musical instruments and singing songs, etc. at the Collectorate, all Sub-Divisional Officer’s Offices, all Tehsil Offices, all Government Offices, is being banned.

It is prohibited to use more than 5 motor vehicles or vehicles in any convoy of vehicles during the election campaign. (This order shall be subject to the order applicable to the safety of the Central or State Government Minister or a high-ranking person with a convoy of defence vehicles and shall not apply in respect of Government vehicles.)

No individual, organization or party worker may use loudspeakers during the election period without the permission of a competent police officer. Also, loudspeakers should not be used when a moving vehicle is running on the road. The loudspeaker cannot be used before 6 am and after 10 pm. The temporary party offices cannot be set up near public places, religious places, hospitals or educational institutions during the election period. Any person violating this order shall be liable to punishment under Section 188 of the Indian Penal Code, said Commissioner of Police Krishna Prakash.

Prohibitory Order Under Maharashtra Police Act

The Code of Conduct will remain in force till the end of the biennial by-election process for Legislative Council teachers and graduate constituencies. Law and order need to be maintained in the Pimpri-Chinchwad Police Commissionerate to ensure smooth, peaceful and fearless conduct of biennial by-elections.

As per Section 36 of the Maharashtra Police Act, 1951, the Pimpri Chinchwad Police Commissionerate has empowered all police station officers in the jurisdiction to conduct elections as under:

Ordering the conduct or action of a person on a road or a procession, determining the time and route by which a procession or a crowd will or will not go, control the timing of loudspeakers used in public places or public entertainment, control the procession’s propaganda and to control the date and time of the public meeting.

This order will be applicable in Pimpri Chinchwad Police Commissionerate till 5 pm on December 5, 2020. Violation of this order is punishable under Section 134 of the Maharashtra Police Act, 1951, stated order by Commissioner of Police Krishna Prakash.
