Supreme Court Sets January 31, 2026 Deadline for Maharashtra Local Body Polls, Raps SEC for Delay
New Delhi, 16th September 2025: The Supreme Court on Tuesday directed that all local body elections in Maharashtra must be completed by January 31, 2026, warning the State Election Commission (SEC) that no further extensions will be granted.
A bench of Justice Suryakant and Justice Joymalya Bagchi pulled up the SEC for failing to act within prescribed deadlines and termed its justifications “administrative laxity.”
The court said elections for Zilla Parishads, Panchayat Samitis, and Municipalities should be concluded within the stipulated time frame.
“The elections to all local bodies shall be conducted by January 2026. No further extension will be given to the State or the State Election Commission. If any logistical assistance is required, the SEC should approach this Court before October 31, 2025. After that, no such prayer will be considered,” the order stated.
The bench also directed that the ongoing delimitation process must be completed by October 31, 2025, making it clear that it cannot be cited as a reason for postponing the polls.
Rejecting the SEC’s explanation regarding the unavailability of electronic voting machines (EVMs), shortage of staff, and non-availability of school premises during board examinations, the court said these excuses reflected “a lack of administrative preparedness.”
“We are constrained to observe that the State Election Commission has failed to take prompt action to comply with the directions of this Court within the prescribed time limit,” the judges remarked.
The bench further noted that since school board examinations are scheduled for March 2026, they cannot justify delaying elections that must be completed by January.
