Pune: Luxury Car Dealership Asked to Return Rs 25 Lakh After Selling Booked Ferrari to Another Buyer

Pune, 30th August 2025: The District Consumer Grievance Redressal Commission has directed Navneet Motors Pvt. Ltd., a luxury car dealership, to refund Rs 25 lakh to a Warje resident who had booked a used Ferrari, along with six percent annual interest from the date of filing the complaint. Additionally, the commission ordered the company to pay Rs 1 lakh as compensation for the loss and Rs 10,000 towards complaint costs.

The order was issued by commission chairman Anil Jabalekar and members Sarita Patil and Shubhangi Dunakhe in favor of complainant Jayant Anant Shurpali. Shurpali had booked a Ferrari, which had been driven for 13,000 kilometers, at a price of Rs 3.82 crore in January 2020 by paying a booking amount of Rs 25 lakh. Due to the onset of the COVID-19 pandemic, Shurpali could not pay the remaining amount. Later, he discovered that the car had been sold to another buyer, prompting him to demand a refund.

When the company failed to respond, Shurpali approached the Commission through advocates Suresh Tikhe and Vitthal Kale. Navneet Motors argued that, under the sales agreement, the booking amount could be confiscated if the deal was canceled. The company also claimed that Shurpali did not qualify as a “customer” under the Consumer Protection Act.

The Commission rejected these arguments, noting that confiscating the entire booking amount without evidence is not in accordance with the law. The company failed to submit the sales agreement even after repeated opportunities. The order emphasized that Shurpali is clearly a customer since the booking was made for purchasing a car, and accepting money from two buyers for the same vehicle is illegal.
