Bombay High Court Issues Notices To Government Authorities On PIL Demanding Rs 5000 Pension For Old Age Persons In Maharashtra

Pune/Nagpur, 6th January 2021: Taking serious cognizance of the plight of the old age persons who are not getting proper pension amount, the Nagpur Bench of Bombay High Court consisting of Justice SB Shukre and Justice AL Pansare has issued notices to the State of Maharashtra, Ministry of Women and Child Development, Ministry of Revenue and Union Of India.

The Public Interest Litigation (PIL) was filed by educationist Heramb Kulkarni and social worker Mahesh Pawar and argued by Adv. Asim Sarode and Adv. Smita Singalkar. The petition mentions that in Maharashtra State the Government provides just Rs 1000 per month as financial assistance to destitute old age persons. The very meagre amount of rupees 33 per day is very insufficient to survive. The petition also narrates that because of the rising inflation of prices and the lockdown situation the old age persons are facing neglect on all levels.

Some States like Telangana are providing 2000 rupees, Andaman Nicobar, Goa, Kerala are also providing 2000 rupees per month and Delhi is giving 4500 rupees per month to old age people. On this background, the petitioners sought directions to be given to the government to increase the amount of pension to the destitute old age person and make it 5000 rupees.

Petitioners also suggested the Court direct Union Of India to increase 15% of its share in the budgetary provision of economic support for old age persons, the petitioners are expecting that rupees 500 each year in the pension amount may be increased each year. The outcome of this PIL will benefit over 50,000 old age and destitute persons in the State of Maharashtra.

The respondents (government authorities) have been directed by the High Court to submit their reply within three weeks and the matter is listed for further hearing around 27th January 2022.
