New Delhi, 2nd July 2022: Chief Justice of India MV Ramana has made a big comment on the judiciary and legislature. He said the ruling parties believe that government action deserves judicial support and the opposition parties hope it will support their cause. But it is important to understand that the judiciary is only answerable to the Constitution.

He said that the country has still not learned to fully appreciate the roles assigned to each institution by the Constitution.

Speaking at a felicitation function organized by the Association of Indian Americans in San Francisco on Saturday, CJI Ramana said, “As we celebrate the 75th year of independence this year and as our republic turns 72, so with some regret, I must add here that we have still not learned to fully appreciate the roles and responsibilities assigned to each institution by the Constitution. The ruling party believes that every government action is judicial and deserves support. Opposition parties expect the judiciary to pursue its political positions and cause. While the judiciary is only answerable to the Constitution.”

The CJI said, “It is the great ignorance among the general public that it is only by helping such forces whose sole objective is to destroy the judiciary. Let me make it clear, we are accountable to the one and only the Constitution.”

He said that “We need to promote constitutional culture in India to implement the checks and balances envisaged in the Constitution. We need to spread awareness about the roles and responsibilities of individuals and institutions. Democracy is about the participation of all.”

Citing the example of the United States of America (USA), the CJI stressed the need to honour inclusivity “everywhere in the world including India” and cautioned that “a non-inclusive approach is an invitation for disaster.”

Appreciating the achievements of the Indian community, the CJI said, “It is the tolerant and inclusive nature of American society that has been able to attract the best of talent from around the world, which in turn is contributing to its growth. It is also necessary to honor deserving talents from diverse backgrounds to maintain the faith of all sections of the society in the system.”

Policies change with the government

The CJI said that such a foundation built for long-term development should never be hampered. Policies change with the change of government all over the world. But no sensible, mature and patriotic government will change the policies in such a way that it slows or stops the development of its own region.

He regretted that “unfortunately, whenever there is a change in government, we do not often see such sensitivity and maturity in India”.
