Occupancy Certificate Not Required In Maharashtra For Deemed Conveyance

Pune, 13th February 2023: Housing societies do not need to have the occupancy certificate (OC) of the building to apply for and receive deemed conveyance.

According to Maharashtra state cooperation department officials, citing a “rather unknown” government resolution (GR) of 2018 was implemented to expedite deemed conveyance for such societies throughout Maharashtra.

A rider to the facility requires the housing society to submit a self-declaration form stating that it would pay the requisite fees and obtain OC from the local authorities in the future.

The Sylvan Retreat society contacted the state cooperation department for the conveyance deed after almost two decades of waiting, and after submitting the self-declaration form, the Pune district deputy registrar issued it to them in five months. To obtain OC and pay the necessary dues, the society has now contacted the municipal organisation.

Few societies without OC have yet to apply for considered conveyance in Maharashtra, according to the officials, because of a lack of knowledge about the GR.

The GR, which was published on 22nd June 2018, permitted societies without OC to apply for presumed conveyance both online and offline after submitting a self-declaration form.
