Pimpri Court Acquits Man Accused Of Outraging Modesty Of BJP Woman Corporator
Pimpri Chinchwad, February 17, 2021: The Pimpri Court of Judicial Magistrate First Class (JMFC) on February 10 acquitted Dattaram Sakharam Salvi (55), a resident of Sant Tukaram Nagar, Pimpri accused of outraging the modesty of a woman Corporator of BJP of Pimpri Chinchwad Municipal Corporation [PCMC].
He was charged for offences under sections 354, 504, 506 of Indian Penal Code (IPC). The case of the prosecution was that on 7th March 2015, the corporator was assaulted and her modesty was outraged by the accused when she was trying to unload a truck of cement paving block at Sant Tukaram Nagar, Pimpri. To prove the said case the prosecution examined two eyewitnesses who are friend and sister-in-law of the corporator. Further prosecution also examined two panch, which turned hostile.
The defence lawyers argued that the said FIR came to be filed against accused using the political influence of the Corporator as the accused’s wife who was chairman of Ashirwad Housing cooperative society, Sant Tukaram Nagar had filed a case at co-operative court against the brother-in-law of the Corporator, for illegally operating restaurant and bar on a plot reserved for flour mill. Therefore, to pressurize the accused to withdraw the said case of co-operative housing society the corporator filed the said false case under section 354 among others.
The accused had obtained anticipatory bail from sessions court, Pune and also approached JMFC court to file a cross complaint against the corporator. The JMFC issued an order and directed registration of FIR. Accordingly, Pimpri police station registered an FIR for offences under sections 298, 323, 324, 341, 352, 354, 355, 500, 504, 506, 509 under the IPC in 2015 which is still pending.
Considering all these points JMFC NT Bhosale acquitted the accused.
After registration of the FIR, the accused pursued a Law degree and is now an Advocate.
