Pune Court Grants Bail To DS Kulkarni In MOFA Case

Pune, 21st July 2022: A Pune court today granted bail to builder and developer Deepak Sakharam Kulkarni (Director of DSK Group of Companies) in a Maharashtra Ownership of Flats Act (MOFA) Case registered against him in 2016.

Advocate Aashutosh Srivastava along with his junior Adv. Ritesh Yeolekar represented DS Kulkarni and his wife Hemanti Deepak Kulkarni in an FIR that was registered with Sinhagad Police Station, Pune on 13th August 2016.

According to the FIR, Kulkarni and his wife took an advance amount from the flat buyers and they deliberately failed to deliver the said possession of the flats to the said buyers. Kulkarni couple was arrested on 5th March 2019 and were already in judicial custody in regards to the main FIR since 17th February 2018 and has been incarcerated since then.

The court of Justice SK Dugaonkar today granted bail in connection to the MOFA Act. Advocate Aashutosh Srivastava who represented the couple in the bail matter said, “DS Kulkarni and his wife has already served around half the punishment for most of the offences, which they have been charged with, amounting to arbitrary detention, which clearly violates their basic human rights guaranteed by Article 9 of the Universal Declaration of Human Rights and Article 21 of the Constitution of India.”

He added, “The bail petition of DS Kulkarni in the main FIR is already admitted before the Supreme Court of India and the same is expected to be heard on 26th July 2022.
