Pune: Divorced Parents Resolve Custody Conflict Through Court Counseling, Prioritizing Child’s Well-being
Pune, 2nd April 2025: A legal dispute over child visitation rights following a divorce was amicably resolved after successful court-mandated counseling. The disagreement, which had escalated due to conflicts between the divorced parents, was settled when the father voluntarily withdrew his demand to meet the child, acknowledging the potential psychological impact of ongoing legal battles on the child’s well-being.
A couple were married on 5th July 2005, under Hindu customs. Initially, their married life was stable, and they had a son, who is now eight years old. However, over time, irreconcilable differences emerged, leading to their mutual decision to file for divorce, which was granted in August 2021. As per the court ruling, the child’s custody was awarded to the mother.
Following the divorce, the mother allowed the father to meet their son. However, further disputes arose due to personality differences and concerns regarding the father’s alleged substance abuse and inability to care for the child. As a result, the mother restricted the father’s access to their son. In response, the father, through Adv Atul Gund Patil, filed a legal petition seeking visitation rights. The mother was represented by Adv Sachinkumar Gelda, assisted by Adv Amol Bhosale.
During legal proceedings, the mother justified her decision, citing the father’s substance abuse as a risk to the child’s well-being. The matter was referred to the Lok Adalat for mediation. Court-appointed counselors successfully facilitated a resolution, persuading both parties to consider the child’s future. Ultimately, the father withdrew his petition, and the case was closed, allowing both individuals to move forward with their independent lives.
