Pune Election: Companies, Establishments Ordered To Grant Leave Or Break To Employees On Day Of Polling
Pune, 16th February 2023: The Department of Industries, Energy and Labor has issued a circular on granting paid leave or a two-hour concession to workers, officers, and employees working in industrial establishments on the day of by-election polling.
The circular is in line with Section 135(b) of the Representation of the People Act, 1951, which provides for voters to be given ample leave or reasonable concessions in working hours to exercise their right to vote.
In recent elections, it has been observed that many institutions and establishments are not giving their employees sufficient leave or concessions, which is detrimental to democracy. Therefore, the circular instructs all corporations, industrial groups, companies, institutions, and industrial undertakings under the department to comply with these instructions strictly.
The circular also highlights that workers who are voters in the constituencies where elections are held should be given sufficient leave to exercise their right to vote, even if they are working outside the constituencies where elections are held. Moreover, if it is not feasible to give a full day off, workers should be given a concession of at least two hours in exceptional circumstances, subject to prior permission from the concerned Collector and District Election Officer.
It is crucial that industrial establishments follow these instructions to ensure that all voters can exercise their right to vote. The circular also warns that appropriate action will be taken against any establishments that fail to comply with these instructions or receive complaints from electors about not being able to vote due to not getting proper leave or concessions for voting.
