Pune: Vishal Agarwal Released on Bail, Rearrested for Defrauding Flat Owners
Hinjawadi, 3rd July 2024: The district court on Tuesday granted bail to construction businessman Vishal Agarwal and his father Surendra Kumar Agarwal in the case of threatening their family driver in the Kalyani Nagar Porsche accident case. However, Vishal Agarwal was promptly arrested by the Pimpri-Chinchwad police in a separate case under the Maharashtra Flat Ownership Rights (MOFA) Act for defrauding 72 flat owners in the Bavdhan area.
In the Kalyani Nagar accident case, driver Gangadhar Herikrub was allegedly threatened by the Agarwals to take the blame for the minor driver involved in the incident. A case was registered against Vishal and Surendra Agarwal at the Yerwada police station for detaining Gangadhar in their bungalow. They were granted bail in this case.
The court granted bail to Vishal Agarwal under several conditions: he must attend the police station twice a week, remain within Pune district limits, submit an affidavit to the police, and refrain from pressuring witnesses. Assistant Public Prosecutor Yogesh Kadam represented the government, while Advocate Prashant Patil argued for the defence.
Surendra Agarwal, who had been in Yerwada Jail for the past month along with his son Vishal is now out of jail. However, Vishal Agarwal rema, ins in judicial custody at Yerwada Jail for allegedly tampering with blood samples of a minor. He has not yet been granted bail in this case.
Adding to his woes, Vishal Agarwal faces new charges under the MOFA. He and his accomplices are accused of defrauding 72 flat owners of Nancy Brahma Co-op Housing Society in Bavdhan. The Hinjewadi police arrested Agarwal, and he was presented before First Class Magistrate V.P. Khandare’s court. The court ordered Agarwal to be remanded in police custody until July 5. Assistant Public Prosecutor Vijaysinh Jadhav represented the government in this case.
The case dates back to 2007, when 71 people purchased flats in Nancy Brahma Co-op Housing Society. The society owns open spaces, including amenity areas and parking. It is alleged that builder Vishal Agarwal and his associates constructed an eleven-storey building on the society’s premises without obtaining permission from the members of Nancy Brahma Society.
