Mumbai, 11th May 2023: After filing a petition regarding Maharashtra’s power struggle, the Supreme Court has announced its historic decision today. The Supreme Court has noted that the Shinde-Fadnavis government has done many illegal things when the said government came to power.

However, since Uddhav Thackeray has resigned from the post of Chief Minister on his own, the Supreme Court has clearly said in its order that they cannot help him even if they want to, resulting in Chief Minister Eknath Shinde’s government being safe. On the whole, it has been proved that Eknath Shinde’s position as Chief Minister is due to Uddhav Thackeray’s resignation.

When the hearing on the power struggle in Maharashtra started in the Supreme Court, the Supreme Court recorded three observations in the first ten minutes.

Appointing Bharat Gogawle as Chief Whip, trying to show that they are the Shiv Sena party and interference by the Governor in the election of the Speaker of the Legislative Assembly has been declared illegal by the Supreme Court. Hence, now it seems that the result of the said case will completely give relief to the Thackeray group.

A petition has been filed by Shiv Sena to impeach 16 MLAs against the fact that 40 MLAs from Shiv Sena rebelled and formed the state government along with the Bharatiya Janata Party (BJP). After several months of hearings, the final reading of the verdict has begun today before a five-judge bench.

Meanwhile, when the result was announced, discussions about who will benefit from the same arised in the state since last month. Today’s judgment will give a historic verdict on whether the Shinde government is anti-constitutional or constitutional.

After the hearing started today in the Supreme Court, the appointment of Bharat Gogawle as the Chief Whip was said to be unconstitutional, after which Eknath Shinde and his group claimed from time to time that they are Shiv Sena.

The said claim was also rejected by the court and according to Article 10, this action was said to be unconstitutional while expressing displeasure with the working method of the then Governor Bhagat Singh Koshyari. It has been stated that Koshyari has no right to interfere in the election of a member of the Legislative Assembly.

While the Eknath Shinde government was in trouble on these three issues, the Eknath Shinde government got the biggest gain on the fourth issue. “We cannot help only because he has resigned from his post,” the court said while reading the verdict. Hence, the Shinde-Fadnavis government has been proven to be safe.
