Bibvewadi, 29th March 2023: Avinash Phatak (72) and Madhuri Phatak (67), an elderly couple residing in the Bibvewadi area of Pune, staged a symbolic hunger strike in front of their own house to protest the misery caused by their tenant, Atish Jadhav. The couple had leased their bungalow, named ‘Saraswati’, in Sadanand Society on Sitaram Bibwe Path to Jadhav on a five-year lease to run a nursery school named ‘Kidzi’.

However, despite the provision in the registered tenancy agreement that required the tenant to vacate the premises if rent was unpaid for three consecutive months, Jadhav has not paid the rent for the last 3.5 years.

Moreover, Jadhav has also been conducting other business illegally by keeping tenants on the property. The Phatak couple’s repeated calls and attempts to meet Jadhav have been avoided, leading them to approach the court.

However, neither Jadhav nor his lawyers have appeared in court, leaving the elderly couple in a financial crisis. The legal battles have been costing heavily, and as a result, the couple has no other source of income except for the rent, which is unpaid.

“In all this, we have found ourselves in a financial dilemma. We have to rent or live in our daughter’s house, despite having our own home. All this has created huge mental stress on both of us, and my blood pressure and heart problems have increased. My wife Madhuri has started suffering from insomnia, and constant worry has made life difficult for both of us. We are fed up with Jadhav’s harassment and delaying of court, and we are left with no other option but to go on hunger strike,” said Avinash Phatak.

Several other elderly citizens supported their protest by sitting with them during the hunger strike. The couple’s protest aims to draw attention to the financial hardship caused by Atish Jadhav’s actions and to urge the court to take action on the matter. The contract between the Phatak couple and Jadhav is due to expire at the end of this year, but the couple remains concerned about the legal battles and their financial future.

The situation highlights the importance of landlords having strict policies in place for tenants to follow to prevent such situations. Legal agreements and proper communication between landlords and tenants can prevent such issues from arising. In this case, the elderly couple’s plight has highlighted the urgent need for the judicial system to act promptly and provide justice to them.
