Supreme Court Overturns High Court Ruling Regarding Adoption Of Strays
Delhi, 16th November 2022: On Wednesday, the Supreme Court ruled that no coercive measures could be used to enforce the Bombay High Court’s (Nagpur Bench) ban on feeding street dogs in public. The High Court’s ruling that people who feed street dogs must adopt them was also overturned by the court.
The following statement in the High Court’s order was overturned by a bench of Justices Sanjiv Khanna and JK Maheshwari: If these so-called friends of stray dogs are interested in the protection and welfare of the stray dogs, they must adopt the stray dogs, take home the stray dogs, or at least put them up in some good dog shelter homes and bear all the expenses for their registration with Municipal Authorities and towards their upkeep.
While debating a special leave petition submitted by a group of dog lovers opposing the High Court’s judgement, the bench issued the interim order.
The Nagpur Municipal Corporation was also given a directive by the court to make arrangements and take action so that people can feed stray dogs in designated areas. It will be up to the municipal authorities to deal with any nuisance caused by the street dogs following the law until the locations are identified.
