Dismissed employee takes legal action against Pune based MNC

Pune, 21st December 2022: USA based MNC which is headquartered in Pune is facing legal action from its own dismissed senior employee, a partner with the company,the matter is about the termination contract and non-compliance of statutory requirements of depositing PF and tax deducted at source from the employee salary.

Delhi resident Rajneesh Kumar decided to take legal action against Exusia India Private Limited, working in analytics,data engineering and cloud solutions. The ex-employee Rajneesh sent a legal notice to the company along with its CEO Trevor Silver , COO Harpreet Mehta and legal head mentioning the non compliance.

In the legal notice, Kuldeep Mansukhani ,Lawyer of Rajneesh kumar said that, his client joined Exusia India on 2nd Nov 2015 in accordance with an employment contract which stipulated a notice of 90 days in the event of resignation by the employee.On 3rd Nov 2022, Rajneesh sent his resignation, due to the company reneging on the additional emoluments agreed on promotion committed by CEO himself in writing.

The dismissed employee said he has resigned with 90 day’s notice according to the job contract but the management of the company subsequently chose to terminate him by giving 30 days’ notice, in retaliation of the resignation letter given to them.

Now Rajneesh demands that the outstanding dues for notice period along with documentary evidence of PF and TDS deposited till date and also the amount due to upgraded incentive plan committed by company be paid to him. The company has given an evasive reply to the issue raised in a legal notice issued by the employee.

It seems the battle will end up in the office of the statutory/Labor authorities,who would be constrained to put such recalcitrant multinational companies on a tight leash by ensuring statutory compliances and the law of labour in the country.
